Contractors and construction firms who operate in the built environment have a unique exposure when they work on a “Design and Construct” basis which involves assuming responsibility for advice, design and specification and a range of other “professional” activities such as project management. 

These professional activities can either be undertaken by in-house staff or, as is often the case, they can be sub-contracted to specialist consultants but either way the contractor assumes the professional risk under a contract and it is common for such contracts to require the Contractor to maintain professional indemnity insurance (PII). Professional indemnity insurance for the construction industry responds to claims which are brought under contract, either directly by a client or by third parties under duty of care agreements such as collateral warranties and novations.

Construction industry claims can be complex and we often see claims where mud is thrown at all parties to a contract in the hope it sticks somewhere. Resolving these issues can be very costly and time-consuming and one of the key benefits of a professional indemnity policy for a contractor is that the Insurers will help to navigate the claims process and defend against spurious claims. In addition, where a contractor is liable for a professional error made by a sub-consultant, PI insurance will take care of the claim in the first instance, to protect a contractor’s cash flow and reputation, leaving insurers to pursue claims against professional consultants who may have been at fault.

What does professional indemnity insurance cover?

Quite apart from the core cover provided in respect of claims payments, the PII policy will provide cover for the Insured firm’s own costs in investigating and defending themselves against claims and these professional and legal costs are often significant and, even where a claim is successfully defended, there is no guarantee that such costs can be recovered.

The construction industry in particular is exposed to an ever-changing litigation environment and in a post Grenfell era with increased liabilities flowing from the Building Safety Act, as an example, it is important that cover available under a professional indemnity policy reflects the state of the insurance art. Cover for fire safety and cladding claims, which has been subject to exclusions in the past, is now available to varying degrees provided the right insurers are engaged, and the right information is provided.
